Exceptional service from Dorela and her assistant Era. I first came to Canada through the LMIA process, and they guided me every step of the way with professionalism and deep knowledge. Later, they also handled my wife's Open Work Permit application, which was approved much faster than expected. Their dedication, attention to detail, and constant support made everything smooth and stress-free. Truly one of the most professional and reliable legal teams we've ever worked with. Highly recommended!
Helping asylum seekers in claiming protection
No human being should be persecuted or discriminated against on racial, religious, political or social grounds. If you feel your life is in danger and your country is unable or unwilling to protect you, Canada can change your fate.
At Sinani Law, we look after the rights of refugees. Our Calgary based refugee lawyers will guide and represent you through the entire IRB application process.
Real outcomes for people seeking protection
Who can claim conventional refugee?
Any foreign national living outside their country for racial, religious, political, or cultural reasons, and who is unable or unwilling to return to their nation. Our immigration law firm in Calgary helps determine whether you qualify.
Are You Persecuted?
Individuals who belong to groups or communities that are persecuted or marginalized in their country are also eligible to apply for refugee status in Canada. Persecution is understood as any threat of death, imprisonment, torture, or violation of human rights executed by the government or non-governmental entities.
Important Institutions
The independent tribunal responsible for granting this status is the Refugee Protection Division of the Immigration and Refugee Board (IRB). However, Immigration, Refugees and Citizenship Canada (IRCC) may also issue a decision.
Why Canada helps people needing protection
Canada is a country that deeply values human rights, freedom, and empathy. The Canadian refugee protection system was created with a clear objective: to bring hope to those persecuted and marginalized in their own countries.
Immigration to Canada
The Refugee and Humanitarian Resettlement Program, aimed at foreign nationals seeking protection from outside Canada.
Refugee Claims
The In-Canada Asylum Program, for people who are already in Canada and need protection.
"At Sinani Law, our refugee lawyer Calgary honors this system by helping you achieve a fairer life, with a hopeful future full of opportunities."
Common grounds to seek asylum
If you want to engage the services of a Calgary refugee attorney to help you move to Canada, you must show that you are a victim of one of the following forms of persecution:
Racial Ground
When the persecution is carried out entirely on racial or ethnic grounds.
Nationality
When the persecution is carried out in the name of nationality, meaning citizenship as well as ethnic or linguistic group.
Political Opinions
Applies to persons who are persecuted for their political opinion, in which the government or state machinery may intervene.
Religion
When the freedom to express faith in public or private and practice, teach, or worship it is being violated.
Social Groups
When the person belongs to a social group fighting against discrimination and defense of human rights.
Can't find your category?
Our refugee immigration lawyer can help you identify the category that best fits your situation and prove that your country is unwilling or unable to provide the protection you need.
Talk to a lawyerWhat happens if your claim is refused?
If your application for refugee status or permanent residence in Canada is rejected, there are still some options to explore. If you have the right, you can appeal the Refugee Board's decision to the Refugee Appeal Division (RAD).
Potential mistake
The Refugee Board made a mistake or mistakes in your case.
If all indications say you have a right to appeal, you must file a Notice of Appeal form no later than 15 days after receiving the Refugee Board's written unfavorable decision. Until the RAD makes a decision, no one can remove you from Canada. As stated by the Government of Canada, it is best to have a lawyer represent you throughout this process.
No reliable basis
The RAD ruled that your application 'has no reliable basis' or is an 'unfounded representation.'
Missed hearing
You did not attend your refugee hearing or did not file your base claim form on time.
Revoked status
The Refugee Board granted the Minister's application to issue an order for the cessation or vacation of your refugee protection status.
New moments
You have new evidence that would have been helpful to you in obtaining Refugee Board approval.
Previous claim in USA
The application was filed at a U.S. land port of entry, which may be subject to a Safe Third Country Agreement (STCA) exception.
Claim withdrawal
Your refugee claim in Canada was withdrawn.
Law changes
The Federal Court ordered a rehearing following an application for judicial review before December 15, 2012 or an application was referred to the Refugee Board by December 15, 2012.
Removal & deportation of failed refugee claims
If your refugee claim is rejected, you will receive a removal/deportation order requiring you to leave Canada.
Departure Order
Orders you to leave Canada within 30 days of the order coming into force. When you leave the country, you must notify the Canada Border Services Agency (CBSA) of your departure. If so, you may return to Canada in the future, as long as you meet the current entry requirements. On the other hand, if you fail to comply with any of the conditions of the order, the order will immediately become a Deportation Order.
Exclusion Order
Stipulates that you cannot return to Canada within 1 year. In cases of an exclusion order for false declaration, you will not be able to enter Canada for 5 years.
Deportation Order
Prohibits you from returning to Canada indefinitely, so the only way to enter the country is with an ARC.
