What Happens if Claim is Refused?
If your application for refugee status or permanent residence in Canada is rejected, there are still some options to explore.
If you have the right, you can appeal the Refugee Board’s decision to the Refugee Appeal Division (RAD).
However, for this process to proceed, you must show that:
Potential mistake.
The Refugee Board made a mistake or mistakes in your case.
You may NOT appeal to the Refugee Appeal Division if:
The RAD ruled that your application “has no reliable basis” or is an “unfounded representation.”
Missed hearing.
You did not attend your refugee hearing or did not file your base claim form on time.
Revoked status.
The Refugee Board granted the Minister’s application to issue an order for the cessation or vacation of your refugee protection status.
New moments.
You have new evidence that would have been helpful to you in obtaining Refugee Board approval.
Previous claim in USA.
The application was filed at a U.S. land port of entry, which may be subject to a Safe Third Country Agreement (STCA) exception.
Claim withdrawal.
Your refugee claim in Canada was withdrawn.
Law changes.
The Federal Court ordered a rehearing following an application for judicial review before December 15, 2012 or an application was referred to the Refugee Board by December 15, 2012.
On Time Appeal
If all indications say you have a right to appeal, you must file a Notice of Appeal form no later than 15 days after receiving the Refugee Board’s written unfavorable decision.
Until the RAD makes a decision, no one can remove you from Canada.
As stated by the Government of Canada, it is best to have a lawyer represent you throughout this process.
What is Removal/Deportation of Failed Refugee Claims?
If your refugee claim is rejected, you will receive a removal/deportation order requiring you to leave Canada.
Depending on the case, you may receive one of these removal orders and must abide by the consequences:
Departure Order:
Orders you to leave Canada within 30 days of the order coming into force. When you leave the country, you must notify the Canada Border Services Agency (CBSA) of your departure. If so, you may return to Canada in the future, as long as you meet the current entry requirements. On the other hand, if you fail to comply with any of the conditions of the order, the order will immediately become a Deportation Order.
Exclusion Order:
Stipulates that you cannot return to Canada within 1 year. In cases of an exclusion order for false declaration, you will not be able to enter Canada for 5 years.
Deportation Order:
Prohibits you from returning to Canada indefinitely, so the only way to enter the country is with an ARC.
